Although it is in the rule books that throwing the ball in the air is a penalty, if the ref never threw the flag, no one would have raised an eyebrow. To say it is not a judgment call means that it is a quantitative not a qualitative judgment. Would it have been a penalty at 1 foot over his shoulder? 1 inch? 10 feet? Launched into Puget Sound?

The ref has been publicly vindicated by the rule, and the rule is obviously too broad, but the refs are there for their judgment and this was a ridiculous application and violated the spirit of the rule.
